Terms and Conditions 

§ 1 Scope

 The following Terms and Conditions regulate the contractual relationship between stocubo GmbH, represented by Julia Haneke, Exerzierstraße 14, 13357 Berlin, HRB number: 139168, VAT number: DE280888115, and consumers and businesses that buy new goods via our shop.

We do not recognise conditions that contradict or deviate from our own Terms and Conditions. The contract language is German.

§ 2 Conclusion of contract

The offers on the Internet represent a non-binding invitation to you as the buyer to submit a binding offer by placing an order, which we can then accept. 

  1. The conclusion of a contract in electronic business transactions via our shop system therefore comprises the following steps: Warenkorb“ klicken
    You select the products in the desired specification (type, colour, number) and place them in the shopping cart by clicking on "Buy".

  2. After clicking on the “Proceed to checkout” button, choose whether you wish to register as a customer or continue as a guest.

  3. In the following steps you enter the billing and delivery address and select the shipping and payment method.

  4. You can then check your order again and edit the information you have entered if necessary. Here you can also make comments on your order or change it again by clicking the link "Edit shopping cart".

  5. By clicking on the "Buy Now" button, you make a binding offer to conclude a purchase contract with us.

  6. With the order confirmation, which is sent immediately by email, we declare our acceptance of the offer and the purchase contract is thus concluded.
    Orders can also be placed in person or by telephone, email or fax. In these cases, the conclusion of the contract comprises the following steps:
    (7) You submit a binding offer by naming the desired specification (type, colour, number), either orally or in text form.
    (8) We will immediately send you an email confirming that the order has been received and attach an order confirmation.
    (9) The purchase contract is concluded when the confirmation email is sent.

§ 3 Prices and shipping costs 

All prices mentioned in the shop are (gross) final prices and include the statutory VAT applicable in the respective country of delivery. In addition to the final prices, there are additional shipping costs, which depend on the shipping method and the amount of the order, and which are displayed before the order process is completed. Further information on shipping costs can be found on the website. 

§ 4 Terms of payment and delivery 

The delivery or receipt of the goods takes place solely following advance payment.

The following payment methods are available: advance bank transfer, payment via the payment service provider PayPal, cash, or payment with an EC card when collecting the goods.

Unless you pick up the goods from us and pay for them yourself, ordered goods will only be produced and prepared for shipping immediately after receipt of payment. Delivery times are based on the current order volume and production time and are listed in the current information on our website. If we are unable to meet the specified delivery times, you must allow us a reasonable period for subsequent delivery. If we fail to deliver by the end of this period, you are entitled to withdraw from the contract

§ 5 Delivery area 

In principle, we only deliver solely within Germany and to Austria, France, Belgium, Denmark, the Netherlands, Luxembourg, Italy, Spain and Switzerland.

Deliveries to other countries are possible solely on request and not through our online shop. If you wish to have goods delivered to a country other than the EU member states listed above, we will be happy to determine the relevant shipping costs on request.

§ 6 Drafting of the contract 

Your order, including details of the concluded contract (e.g. product type, price, etc.) is saved by us. The Terms and Conditions are sent to you together with the order confirmation and can also be accessed at any time following the conclusion of the contract through the provider's website or downloaded as a PDF using this link.  

As a registered customer, you can access your previous orders via the customer login area (Login).

You can change your selection at any time before sending your order by changing the number of products in the shopping cart and/or by clicking the "cross symbol" to delete the selected item. The changes are then applied by clicking on "Update". You can completely end the ordering process at any time by closing the browser window.

§ 7 Data protection

When initiating, concluding, processing and reversing a purchase contract, we collect, store and process data in compliance with statutory provisions. § 8 Notice of your right to withdraw from the contract (Cancellation Policy) 

If the purchase contract was concluded using remote means of communication (through our online shop, or by phone or email), you have the right to withdraw from this contract within 100 days without giving reasons.

The cancellation period is 100 days from the day on which you or a third party nominated by you, and who is not the carrier of the goods, has taken possession of the last of the goods.

In order to exercise your right of withdrawal, you must send us (stocubo GmbH, Exerzierstrasse 14 in 13357 Berlin, Telefon: 030-21913196,  E-Mail: [email protected] a clear statement (for example in a letter sent by post, a fax or an email) of your decision to withdraw from this contract. You can download and use our specimen withdrawal form for this purpose, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send notification of the exercising of your right of cancellation before the cancellation period has expired.


§ 9 Consequences of Withdrawal 

If you withdraw from this contract, we shall refund all payments that we have received from you, including delivery costs (with the exception of the costs incurred by choosing a different type of delivery than the cheapest standard delivery that we offer) immediately and no later than within 100 days from the day on which we receive notification of your withdrawal from this contract.

Such repayment shall be made using the same method of payment that was used during the original transaction, unless expressly agreed otherwise. Under no circumstances will you be charged for this refund. 

We may withhold the refund until we have received the returned goods. You must return or hand over the goods to us immediately, and in any event no later than 100 days from the date on which you notify us of your withdrawal from this contract. The deadline shall be deemed to have been observed if you send the items prior to expiry of the 100-day deadline.

The cost of returning goods within Germany shall be borne by us. You shall be liable for any loss in the value of goods only if this loss in value is due to use that is not necessary to inspect the nature, properties and functionality of the goods.


§ 10 Online Dispute Resolution

Online dispute resolution in accordance with Art. 14 (1) ODR-VO: the European Commission provides a platform for online dispute resolution (ODR), which is available at http://ec.europa.eu/consumers/odr/.   

§ 11 Warranty Rights

Statutory warranty rights are applicable to all goods from our shop.

§ 12 Applicable Law, Severability Clause

German law applies exclusively. This choice of law only applies to consumers solely insofar as it does not restrict any mandatory statutory provisions of the state in which they have their domicile or habitual residence.

 The invalidity of any single provision of these General Terms and Conditions does not effect the validity of the remaining provisions. The General Terms and Conditions are also available for download.
